A. Platform Disclaimer (Read First)

AdventStayBnB® is a digital marketplace platform only. We do not own, operate, manage, inspect, supervise, certify, warrant, endorse, or control any property, accommodation, transport, tour, activity, or service listed on the Platform.

Listings are created and provided by independent third-party Hosts and service providers.

Any booking, stay, or service contract is strictly between the Host and the Guest. AdventStayBnB® is not a party to such contracts and is not responsible for performance, safety, legality, quality, or outcomes.

No Agency Relationship: Nothing on the Platform creates any partnership, joint venture, employment, agency, or fiduciary relationship between AdventStayBnB® and any Host or Guest.

AdventStayBnB® does not provide travel, accommodation, transport, or tour services and is not a travel agent.

B. Terms & Conditions (All Users)

1. Acceptance of Terms

By accessing or using the Platform, you agree to this Legal Pack. If you do not agree, you must discontinue use immediately.

2. Eligibility

You must be at least 18 years old and legally capable of entering binding contracts. You agree to provide accurate information and keep it updated. You are responsible for all activity conducted through your account and for maintaining the confidentiality of your login credentials.

3. Platform Role

We provide a marketplace and communication tools to connect Hosts and Guests. We do not guarantee the accuracy, availability, pricing, legality, quality, suitability, or safety of any listing or service.

We may remove content, limit visibility, suspend accounts, or terminate access with or without notice, where permitted by law.

4. Accounts & Conduct

You agree not to misuse the Platform, commit fraud, harass others, upload unlawful content, infringe intellectual property, violate privacy, attempt to hack or disrupt services, or violate applicable laws. Violations may result in suspension or termination.

5. Bookings, Payments & Fees

Hosts set prices, house rules, and booking conditions. AdventStayBnB® may facilitate payments as a marketplace intermediary and may charge disclosed service fees.

Payments may be processed by third-party payment processors. AdventStayBnB® is not responsible for chargebacks, reversals, currency conversion losses, or payment disputes initiated by users or payment processors.

6. Cancellations & Refunds

Cancellation and refund terms are set by Hosts and/or Platform policies displayed at booking. To the maximum extent permitted by law, AdventStayBnB® does not guarantee refunds and is not liable for losses arising from cancellations, overbooking, non-availability, travel disruptions, or force majeure events.

7. Reviews & Content

Users may post reviews and content. Reviews reflect individual user opinions only and do not represent the views of AdventStayBnB®. We may remove content we consider false, misleading, unlawful, or harmful.

8. Risk Assumption

Travel, accommodation, and in-person interactions involve inherent risks (including illness, injury, crime, theft, property loss, and service disruption). You voluntarily assume all such risks.

9. Limitation of Liability

To the maximum extent permitted by law, AdventStayBnB® is not liable for any injury, death, illness, theft, loss, damage, fraud, misconduct, service failure, misrepresentation, cancellation, delay, or dispute arising from use of the Platform or interactions between Hosts and Guests.

Where liability cannot be excluded by law, AdventStayBnB®’s total liability shall not exceed the total service fees (if any) paid by the user to the Platform in the preceding 12 months.

10. Disclaimer of Warranties

The Platform is provided “as is” and “as available”. We disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless AdventStayBnB® and its operators, directors, staff, contractors, and partners from claims, losses, liabilities, damages, penalties, and expenses arising from your use of the Platform, listings, bookings, content, or legal violations.

12. Governing Law, Mediation & Jurisdiction

This Legal Pack is governed by the laws of the United Republic of Tanzania. Parties shall first attempt amicable settlement. If unresolved, disputes shall be submitted to confidential mediation or arbitration in Tanzania, unless mandatory law requires otherwise. Where arbitration is not permitted, courts of Tanzania shall have exclusive jurisdiction.

13. Changes

We may update this Legal Pack from time to time. Continued use of the Platform constitutes acceptance of updates.

14. Severability

If any provision of this Legal Pack is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

This Legal Pack constitutes the entire agreement between users and AdventStayBnB® regarding use of the Platform and supersedes all prior communications.

C. Host Agreement (Hosts Only)

Hosts are independent third parties solely responsible for their properties, services, staff, guests, compliance, taxes, permits, and insurance.

Failure to maintain adequate insurance is solely the Host’s responsibility.

Hosts agree to indemnify AdventStayBnB® against claims arising from property conditions, injuries, death, illness, legal non-compliance, misrepresentation, or disputes related to their listings.

D. Guest Agreement (Guests Only)

Guests are responsible for their conduct, safety, and compliance with house rules.

Most disputes are between Guests and Hosts. AdventStayBnB® is not responsible for dispute outcomes.

E. Privacy Policy

We collect account data, booking data, and limited technical data to operate the Platform.

We do not sell personal data.

Where applicable, users may request access, correction, deletion, objection, restriction of processing, or withdrawal of consent, subject to legal obligations.
